Terms of Service

You are contracting with LUXE BUILDS AI. By creating an account, submitting a consultation request, purchasing a package, or continuing to use the website, you confirm you have read, understood, and agreed to these Terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization. If you are an individual, you confirm you are of legal age in your jurisdiction.

We design and build custom, AI-integrated marketing websites for local businesses. Deliverables and inclusions are described in the package you purchase and any written scope agreed during the consultation brief.

LUXE BUILDS AI is the seller of record for all orders. Invoices are issued directly by us and paid through our secure payment page or by another method we agree in writing. We do not collect or store your card or bank details; those are handled by the payment processor on the payment page.

Project packages are billed 50% at the start (deposit) and 50% at delivery. Ongoing Care plans are billed monthly until cancelled. Applicable sales tax, where required, is added to your invoice. Refunds and cancellations are governed by our refund policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date so we can deliver the service and communicate with you.

You agree not to misuse the service. In particular, you must not:

• Use the service for unlawful purposes, fraud, spam, harassment, or to distribute malicious content.
• Infringe the intellectual property, privacy, or other rights of third parties.
• Attempt to probe, scan, scrape, reverse-engineer, or interfere with the security or integrity of the service.
• Circumvent technical limits, resell, or redistribute the service without our written consent.
• Upload content you do not have rights to, or that is illegal, defamatory, or hateful.

You are responsible for any content, prompts, brand assets, and materials you provide, and you confirm you have the rights to use them.

Our websites and workflows may incorporate AI features. AI outputs may occasionally be inaccurate, incomplete, or unsuitable for regulated professional use (legal, medical, financial, tax) without qualified human review. You are responsible for reviewing outputs before publishing or acting on them. We reserve the right to filter, refuse, or remove AI outputs and to suspend accounts that misuse AI features (for example, to generate deepfakes, illegal content, malware, or content that infringes third-party rights).

We retain ownership of our platform, tooling, templates, code libraries, brand, and documentation. On full payment for a project, you receive a limited, non-exclusive, non-transferable license to use the delivered website and creative deliverables for the operation of your business. You retain ownership of the content and brand assets you supply to us and grant us a limited license to host and process them solely to deliver the service. Rights-holders who believe content infringes their rights may contact us at ahollins@luxeaibuild.com for takedown; repeat infringers may be suspended.

We work hard to keep the service reliable but do not guarantee uninterrupted, error-free, or continuously available performance. To the fullest extent permitted by law, the service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost data, or loss of goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.

You agree to indemnify and hold LUXE BUILDS AI harmless from claims, damages, and expenses arising from your content, your unlawful or unauthorized use of the service, or your breach of these Terms.

We may suspend or terminate your access to the service for: material breach of these Terms, non-payment, suspected fraud or security risk, abusive conduct, or repeated or serious policy violations. You may terminate at any time by contacting us to cancel your project or Care Plan. On termination, we will provide a reasonable window to export your data before deletion; access to the delivered site remains subject to full payment.

These Terms are governed by the laws of the State in which LUXE BUILDS AI operates in the United States, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless a mandatory consumer-protection law requires otherwise.

We may update these Terms from time to time; material changes will be posted here with a new “last updated” date. You may not assign your rights under these Terms without our consent; we may assign in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control (force majeure).
